1. Agreement
This End User Licence Agreement (“Agreement”) is a legal agreement between you and Saturn8 Games (“Saturn8”, “we”, “us” or “our”) for your use of the mobile game After Dark (the “Game”). By downloading, installing, accessing or using the Game, you agree to be bound by this Agreement. If you do not agree, do not install or use the Game.
2. Licence
Subject to this Agreement, Saturn8 grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the Game on devices that you own or control, solely for your personal, non-commercial entertainment.
3. Restrictions
Except where applicable law expressly permits it, you must not copy, reproduce, distribute, sell, rent, lease, sublicense, publicly exploit, modify, adapt, translate, reverse engineer, decompile, disassemble, attempt to derive source code from, circumvent technological protections in, or create derivative works from the Game or any part of it. You must not use the Game for unlawful purposes or in a way that infringes the rights of Saturn8 or any third party.
4. Ownership and intellectual property
The Game is licensed, not sold. Saturn8 and its licensors retain all right, title and interest in and to the Game, including its software, characters, artwork, graphics, animation, music, audio, dialogue, stories, designs, logos, names and other content, together with all associated intellectual property rights. No ownership rights are transferred to you under this Agreement.
5. Local saves and game data
After Dark does not require a Saturn8 account and does not use a Saturn8 backend service to store your gameplay progress. Game progress and save data are stored locally on your device and are not uploaded to Saturn8.
Because save data is local to your device, deleting the Game, clearing its data, losing or replacing your device, or certain device or operating-system failures may cause your save data to be lost. Unless a platform-level backup or transfer feature independently preserves that data, Saturn8 cannot recover locally stored save data.
6. Purchases and platform services
If the Game offers paid downloads, in-app purchases or other transactions, those transactions are processed by the platform through which you obtained the Game and are also subject to that platform’s terms, payment rules and refund policies. Saturn8 does not directly receive or store your payment-card details through the Game.
7. Updates and availability
We may provide patches, updates, upgrades or other changes to the Game. Some updates may be required for continued use. We may modify or discontinue features or support where reasonably necessary, subject to applicable law. We do not guarantee that the Game will remain compatible with every device or future operating-system version.
8. Third-party services, advertising and platform terms
The Game may display advertising supplied through third-party advertising and mediation services. At launch, these services may include Unity LevelPlay, ironSource, Google AdMob and Unity Ads. The availability, content and operation of advertisements are provided in part by third parties and may be subject to their respective terms and privacy policies.
Advertising providers may process device, advertising, technical and ad-interaction information for purposes such as delivering advertisements, measuring performance, preventing fraud and, where permitted and consented to, personalising advertising. The handling of information associated with advertising is described in the After Dark Privacy Policy.
Where applicable law or platform rules require consent or permission for advertising technologies, the Game will request or respect the relevant privacy choices. Your use of the Game may also be subject to the terms of the app store, device manufacturer or operating-system provider through which the Game is supplied.
Where you obtained the Game from Apple’s App Store, you acknowledge that this Agreement is between you and Saturn8, not Apple; Saturn8, not Apple, is responsible for the Game and its content, subject to this Agreement and applicable law. Apple has no obligation to provide maintenance or support services for the Game. Apple and its subsidiaries are third-party beneficiaries of this Agreement and, upon your acceptance of it, Apple has the right to enforce this Agreement against you as a third-party beneficiary.
9. Disclaimer
Nothing in this Agreement excludes or limits rights or remedies that cannot lawfully be excluded or limited, including your statutory consumer rights. Subject to those rights, the Game is provided on an “as is” and “as available” basis. We do not promise that it will always be uninterrupted, error-free or compatible with every device configuration.
10. Limitation of liability
Nothing in this Agreement excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to that, Saturn8 will not be liable for losses that were not reasonably foreseeable when you accepted this Agreement, or for business losses arising from personal, non-commercial use of the Game. Your statutory rights remain unaffected.
11. Termination
This Agreement remains in effect until terminated. You may terminate it at any time by uninstalling the Game and ceasing to use it. Your licence may terminate if you materially breach this Agreement. On termination, you must stop using the Game and delete copies under your control. Provisions that by their nature should survive termination, including ownership and intellectual-property provisions, will continue to apply.
12. Changes to this Agreement
We may update this Agreement when reasonably necessary, for example to reflect changes to the Game, applicable law or platform requirements. Where required by law, we will provide appropriate notice. The effective date shown above identifies the current version.
13. Governing law
This Agreement is governed by the laws of England and Wales. If you are a consumer resident elsewhere, you retain the benefit of any mandatory protections provided by the law of your country of residence. Nothing in this Agreement prevents you from bringing proceedings in a court that has jurisdiction under applicable consumer law.
